Could this data include dates of receipt/declaration and the financial value in each instance insofar as this is available within the cost limits set out by the FoI Act. Could this also include the most granular detail possible on the positions held by the individuals concerned while remaining within the Act's stipulations on identifying individuals. (For example, if their specific job title cannot be named, then some designation of the level of office they hold within TfL). Thank you for your request received by Transport for London (TfL) on 22 March 2019 asking for information about hospitality, entertainments and gifts received by TfL employees.

Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy.

I can confirm that we do hold the information you require. However, to provide the information you have requested would exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004.

Under section 12 of the FOI Act, we are not obliged to comply with requests if we estimate that the cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit. In this instance, we estimate that the time required to answer your request would exceed 18 hours which, at £25 per hour (the rate stipulated by the Regulations), exceeds the ‘appropriate limit’.

In order to answer your request we would first need to compile a list of the ‘TfL executives or other managerial officers’ who have been involved with the Northern Line Extension project since May 2010. This is a period of almost 9 years, during which many roles, and the people doing them will have changed.  Were we to be able to draw up a list of relevant employees, we would then need to check against their names to see if any ‘hospitality, entertainments and gifts’ have been received from any of the extensive list of contractors, consultants, sub-contractors and suppliers involved or their holding companies.

This would easily take in excess of 18 hours, before we are in a position to start compiling the additional granular detail you have requested. Furthermore our Gifts & Hospitality Register has included all employees since 2017. Prior to this time it was used only to record gifts and hospitality for senior staff. And these records are only held back to 2012. Therefore were we to compile a list of all the relevant names, and check for any declarations, we would still not be in a position to fully answer your request.

For your information, however, our Policy and Guidance on Gifts and Hospitality states:

1.2 Any gifts or hospitality offered should usually be declined. You should not accept any gift or hospitality where there is a possibility, or a perception, of being influenced by it. There are a few circumstances where acceptance might be appropriate but, as a guiding principle, you should err on the side of caution and refuse any offer where you have any doubt as to its integrity or lavishness.

1.3 Acceptance of any offers of gifts and hospitality must be approved by your line manager and recorded into the Corporate Gifts and Hospitality Register (the Corporate Register) (this is in addition to any local reporting arrangements).
