Thank you for your request received by Transport for London (TfL) on 19 November 2022 asking for information about a Penalty Charge Notice.

Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold some of the information you require.

1. Please let me have a copy of the original of the CEO’s PA Daily Activity Report for the day for the above Penalty Charge Notice that was issued showing the entry(ies) for the alleged contravention and all relevant entries relating to the CEO’s location. You may redact information which relates to other vehicles.
2. If there is no CEO’s Daily Activity Report for the above Penalty Charge Notice please explain exactly why none exists.
3. Please let me have a copy of the original "On Street Log CEO Daily Activity Report (See attached Si-Dem example) for the day for the above Penalty Charge Notice was issued showing the entry(ies) for the alleged contravention and all relevant entries relating to the CEO’s location. This is important!!

There is no requirement under the relevant legislation for CEOs to complete Daily Activity Reports, and therefore this information is not held.
5. Please let me have a copy of the original of the CEO's note book (see above) for the day of the alleged contravention showing the entry(ies) for the alleged contravention and all relevant entries relating to the CEO’s location.
On-Street Officers do not use notebooks or pocket books because all information is held electronically on the handheld units they use while enforcing the red route on our behalf. The information recorded in these handheld units relates to individual Penalty Charge Notices (PCNs). These are considered personal information, and are therefore exempt from disclose under section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.
Anyone in receipt of a PCN can request information relating to their penalty notice by making a Subject Access Request for personal information held by TfL here: https://tfl.gov.uk/corporate/privacy-and-cookies/access-your-data

The recipient of a PCN can view the ticket history online at https://tfl.gov.uk/modes/driving/view-a-pcn

As explained in our response to question 5 above, Penalty Charge Notice information is considered personal information. We will therefore not disclose information on PCNs issued to other people. Information held relating to any PCNs issued to you can be requested by making a Subject Access Request.
