Thank you for your request received by Transport for London (TfL) on 31st August 2024 asking for information about a named taxi driver. Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.
I am afraid that any such information held is exempt from disclosure under section 40(2) of the Freedom of Information Act, the exemption that protects against the unfair release of personal data. Under section 40(2), information is exempt from release if it relates to an identifiable third party and if release is considered to be unfair. In this case, with the individual named in the request, the information clearly relates to an identifiable third party. The question therefore is whether release of the material would be fair. We do not believe that the individual involved would expect that their data would be divulged in this way, and we therefore conclude that release would be unfair.
I note that you do not state what connection you have with the named person – if any – nor why you think any such information should be made available to you. Note that if you are acting on behalf of the named individual then such a request would be handled under data protection law as a Subject Access Request, rather than the Freedom of Information Act.
