You asked
I am writing in connection with your recent answers to the FOI request TfL Ref: 2927-1718.
I note in particular that in your response you have identified some documents as follows:
- South London (Camberwell) Stations Report (July 2014)
- Camberwell Station Re-instatement Economic appraisal (July 2017)
- Camberwell Station Reopening Railplan Strategic Transport Modelling Report (September 2017)
You have said that the documents are not in the public domain, which is quite surprising.
I have re-read the FOI guidance

You have implied that because you are planning to release the business case, that you are withholding release of these documents.
The data and information contained in the original documents supplies raw material and input for the business case document. The business case will consider the different cases (commercial, technical, financial etc) and provide analysis, and make recommendations. We are not asking for a draft of the business case.
ICO explicitly calls out the fact that background research is in a different category, and does not qualify for withholding under section 22.
It would be in the public interest to allow review/analysis by interested parties of the raw material, whilst TfL continues to work on the (long-awaited) business case.
Please could you reconsider your position in this matter, and make public these documents.

Thank you for your email received on 8 March 2018 asking for information about Camberwell Rail station. I sincerely apologise for the delay in replying.
Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm that we hold the information you require.

Work took place to develop the business case during both 2016 and 2017 and drew on a number of supporting areas of work, including a technical design assessment, transport modelling and a wider economic benefit assessment. Each of these assessments informs the business case. These supporting documents provided background evidence to the business case which we expect to publish shortly in Summer 2018.
Please note that in accordance with TfL’s obligations under the Data Protection Act 1998 (DPA) some personal data has been removed, as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the DPA, specifically the first principle of the DPA which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 of the Data Protection Act which would make the processing ‘fair’.
This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption.
