Thank you for your request received by Transport for London (TfL) on 27 February 2018 asking for the CS9 consultation responses and the breakdown of support by postcode. I apologise for the delay in replying.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. You asked for the following:

Cycle Superhighway Route 9 consultation responses

Please provide me with:

1. Copies of the responses from stakeholder and local councillors.

2. The consultation document states that the following number of responses were sent in by postcode:

W6 399 11%

W14 259 7%

W12 187 5%

SW6 60 2%

Please advise how many from each of those postcodes were in support and how many were opposed.

I can confirm that we hold the information you require. However, to provide copies of all the consultation responses from stakeholders and local councillors would be a significant burden to our resources and therefore we are not obliged to provide this information in accordance with section 14 of the FOI Act.

Our principal duty is to provide an effective transport service for London and we consider that answering the first part of your request would represent a disproportionate effort, as this would involve us manually reviewing the 93 consultation responses from stakeholders and local councillors, some of which were very detailed, in order to identify and redact any personal data in accordance with our statutory obligations under section 40 of the FOI Act.    This would be a significant distraction from our work managing the TfL network, requiring re-allocation of already limited resources and placing an unacceptable burden on a small number of personnel. We do wish to clarify that whilst we consider that your request falls under section 14(1) of the FOI Act, this does not reflect a conclusion that it has been your intention to deliberately place an undue burden on our resources.

With regards to the second part of your request, we are currently in the process of analysing the consultation responses we have received. Following this analysis, a report will be published later in 2018 outlining the geographical location of respondents and their views expressed about the scheme together with information about the key issues raised by respondents.

Because we already intend to publish the information you have requested, your request for information is subject to an exception from disclosure in accordance with section 22 of the FOI Act which covers information intended for future publication.

The use of this exemption is subject to a public interest test, which requires us to consider whether the public interest in applying the exception outweighs the public interest in disclosure. We recognise that the release of information would promote transparency and also help inform you about this issue. However, we consider that the release of the information in its current form would not serve the public interest as the analysis is incomplete and could potentially be misleading. Given the relatively short interval before publication we consider that the public interest favours the use of the exception at this time.
