Thank you for your request which we received on 15 March 2024.

 

Your request has been considered in accordance with the requirements of the Environmental Information Regulations (EIRs) and our information access policy.  I can confirm that we hold the information you require. You specifically asked:

 

  1. When was Section 295 (of the GLA Act 1999) established and by whom?

     

The Greater London Authority Act 1999 (“GLA Act 1999”) was/is an Act of Parliament that was passed by the Government of the time. 

Section 295 is part of that Act and came into force on 8 May 2000.

 

  1. Is Section 295 an Act of Parliament?

     

Section 295 is not an Act of Parliament in itself – it is part of the GLA Act 1999 which has a total of 425 different sections and 34 schedules. Section 295 is the general section of the Act dealing with road user charging; it then refers to Schedule 23 of the Act which sets out the legislation in more detail.

 

  1. Who was the judge that passed the ULEZ Expansion Scheme into legislation in 2023?

     

No judge passed the ULEZ expansion scheme into legislation in 2023. A road user charging scheme, such as the one for ULEZ expansion, came into legal force after having been confirmed by the Mayor of London. 

 

If you are referring to the legal case brought by four London borough councils (Bexley, Bromley, Harrow and Hillingdon) and Surrey County Council against the Mayor of London and TfL in 2023, that argued that the expansion scheme was unlawful. The case was heard in the High Court on the 4th and 5th July 2023. The judge, hearing the case, was Mr Justice Swift who dismissed their legal challenge and held that the ULEZ expansion scheme was lawful.
