We answered
TfL Ref: 4612-1718
Thank you for your request received on 8 March 2018 clarifying your earlier request for information regarding the number of driver dismissals forms we have received from the private hire operator Uber London Ltd between 18 October 2017 and 18 February 2018 and the outcome of any subsequent investigations.
Your request has been considered in accordance with the requirements of the Freedom of Information (FOI) Act and our information access policy. I can confirm we hold some of the information you require. You asked:
From 18/10/17 to 18/02/18 how many driver dismissal notifications did TFL receive from PH operator (Uber London Ltd, Operator No 7979). Also, I would like to know the numbers of the outcome of operator’s investigation
a) No Further action taken
b) Suspension (time of driver suspension)
c) Dismissals
d) How many were having police reference numbers & if costs permit a breakdown of numbers of drivers with names as well, please. All are requested under Freedom of Information Act 2000.
Unfortunately, to provide the information you have requested would exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004.
Under section 12 of the FOI Act, we are not obliged to comply with a request if we estimate that the cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit. This is calculated at £25 per hour for every hour spent on the activities described.
We received 300 ‘PHV 105 notification of driver dismissal forms’ from private hire operators between 18 October 2017 and 18 February 2018.
We have estimated that it would significantly exceed the cost limit to provide a response to your current request and to provide a breakdown of the driver dismissal forms received from Uber, along with the other information you have requested on the outcome of any subsequent investigations, including whether there is a police reference number and driver details.
This is because, when the forms are received, they are not categorised by which operator has provided the form, but are instead linked directly to the record for the driver that has been dismissed. It is estimated that it would take between 2 and 3 minutes to manually review each of the 300 forms that have been received to determine which operator submitted the form. Once this is determined and the information collated, we would then need to further review each of those driver cases to determine what action was taken which would take a further 3 to 5 minutes per record. It is unlikely that the forms would contain police reference numbers, but we would need to check each one to be sure.
To help bring the cost of responding to your request within the £450 limit, you may wish to consider narrowing its scope so that we can more easily locate, retrieve and extract the information you are seeking. If you want to refine your request or make a Freedom of Information Act request in future, please bear in mind that the Freedom of Information Act allows you to request recorded information held by us. You should identify the information that you want as clearly and concisely as you can, specifying the types of document that you are looking for. You might also consider limiting your request to a shorter period of time.
Although your request can take the form of a question, rather than a request for specific documents, we do not have to answer your question if it would require the creation of new information or the provision of a judgement, explanation, advice or opinion that was not already recorded at the time of your request.
Please note that we will not be taking further action until we receive your revised request.
In the meantime, if you have any queries or would like to discuss your request, please do not hesitate to contact me.
Please see the attached information sheet for details of your right to appeal.
Yours sincerely
