The de Crittenden case in the high court ruled that parking charges were not fines but civil penalties. That prevented the use of the Bill of Rights to challenge the charges.

TfL considers that the Bill of Rights does not apply to the issue of PCNs

The Road User Charging (Charges & Penalty Charges) (London) Regulations 2001 as amended, The Road User Charging (Enforcement & Adjudication) (London) Regulations 2001 as amended and The Greater London Low Emission Zone Charging Order 2006 as varied.
