We answered

TfL Ref: FOI-4030-2324

Our Taxi and Private Hire team has passed over the elements of your email of 16th January 2024 in which you ask for recorded information.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.

Specifically you asked:

Could you kindly supply a copy of the Health and Safety Impact Assessment for when a Taxi Driver loads suitcases / wheelchairs into the Taxi and unloads the same in reverse from the Taxi and confirm the date it was made.

Could you also confirm how many staff in the LTPH/TFL Department have undertaken any type of disability awareness course and confirm the dates. Could you also confirm if any senior management has performed this course to and supply the dates.”

I am afraid that it is not possible to source the information to answer your requests within the costs limit for responding to FOI cases, as set out under section 12 of the Freedom of Information Act. Under section 12, TfL is not required to provide information if it would cost more than £450 to determine if the requested information is held, and to then locate, retrieve or extract it from elsewhere. This is calculated at a rate of £25 per hour, equivalent to 18 hours work.

In this instance the exemption largely applies on account of your second set of questions. You have provided no dates for the requested data, leaving the timeframe open-ended. Further, the information has not been collated before and there is no quick, efficient or automated way of doing so. There are a number of different courses relating to ‘disability awareness’ that staff may have undertaken, and the information to answer your request will not be held in one place. Given this, and the number of staff covered by the request, it is not possible to source all of the information to answer the request within the £450 limit.

In order to bring your request within the costs limit you may wish to narrow its scope to focus on the information that is of most importance to you. For example, if you restricted the request to the first question (for a copy of the Health and Safety Impact Assessment) then we will be able to consider this accordingly. In considering any refined request I would encourage you to consider the advice and assistance provided by the Information Commissioner’s Office (ICO) on how best to access information from public bodies, available on the ICO website here:

https://ico.org.uk/for-the-public/official-information/#:~:text=The%20Freedom%20of%20Information%20Act%20states%20that%20requests%20must%20be,make%20a%20request%20to%20them.

In particular, please note the advice to not combine requests for recorded information with other correspondence.

Please see the attached information sheet for details of your right to appeal.

Yours sincerely,
