Thank you for your requests asking for information about the meeting between TfL Commissioner, Mike Brown, and Uber CEO Dara Khosrowshahi.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we hold some of the information you require. You asked:

What was XXXX given from the car of the nameless Uber executive?

The item given from a member of the Uber security/logistics team was a branded company pin badge of no apparent financial value.

The name of the Uber Executive who emailed him at 5.15pm on 20/1/20?

The email was sent from a member of the Uber security/logistics team. In accordance with our obligations under Data Protection legislation  as required by section 40(2) of the FOI Act, we are not disclosing this person’s name. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle of Article 5 of the General Data Protection Regulation which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.

This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption.

All or any emails between TFL General Counsel Howard Carter, agreeing/being invited to this Meeting and his reply/advice. Or to and from any Member of TFL Legal.

I am particularly interested in emails between Howard Carter and/or TFL Legal inviting/informing him, or any member of his team, of the Meeting with Dara Kharowski? Any reply including any reasoning in that decision if there was one?

We do not hold this information. Neither Howard Carter - General Counsel, or any member of TfL Legal were invited to the meeting. As previously advised, there was no need for a lawyer to be present as there was no discussion of the regulatory matters that will be considered by the Magistrates’ Court in due course.

Any invitation emanating from Uber firstly requesting a Meeting. Was it TFL Legal they approached First or was it Brown?

The office of Mike Brown, TfL Commissioner, was approached by Uber for the meeting. The emails sent and received before and after the meeting between Mike Brown’s office and Uber are published as part of our response to a previous FOI request:

In accordance with section 21 of the FOI Act, we are not obliged to supply you with a copy of the requested information as it is already accessible to you elsewhere.

Copies of all or any emails between Uber/TFL informing Helen Chapman of a) This meeting, b) The Gift supplied at this Meeting and c) The results of this Meeting in full?

Referring to the Gift which was downstairs in the car. Of course if there was another Gift that they took up in the Special VIP Lift to the Special VIP Rooms next to the VIP phone(s) provided at taxpayers expense? Then please include that.

We do not hold this information. Helen Chapman did not receive an invitation to this meeting, nor did she receive any correspondence regarding the item given at this meeting, or any results of the meeting. Helen Chapman did receive a copy of the meeting note previously disclosed to you as part of FOI-3206-1920 that is also available using the above link.
