You asked

follow up from FOI-3041-2324 1) In relation to the aforementioned, which does TfL believe to be the root cause of the installation of a product that is 'not fit for purpose'? 2) Please explain the logic as to why TfL believes no breach of contract has occurred, given indemnity clauses (in relation to Stanton Williams and lead designer Halcrow) and warranties (in relation to Taylor Woodrow Bam Nuttall) are in place and effective? 3) What is the estimated cost for the removal of the current glass ceiling and the reinstatement of a standard pavement surface in its place? Your detailed response to these specific queries will greatly assist in understanding the factual basis for the current situation and the decisions being made.

We answered

TfL Ref: FOI-3749-2324

Thank you for your follow up email which we received on 15 January 2024, asking about the glass ceiling at Tottenham Court Road station.

Your request has been considered in accordance with the requirements of the Freedom of Information (FOI) Act and our information access policy.

Regarding the cost of removal of the current glass ceiling, it’s difficult to quantify how much it would cost to develop and install a solution which would be acceptable to all stakeholders, at the moment. It may be somewhere between £1-2M; however this is only a rough estimate and may change.

I’m afraid, your other questions do not constitute a valid FOI request. Although a request can take the form of a question, rather than a request for specific documents, the legislation only applies to requests for recorded information. Under FOI, we do not have to answer questions for unrecorded comments, advice and explanation or the provision of a judgement, that was not already recorded at the time of your request. You can contact TfL’s customer services for any non-FOI related queries.

Please see the attached information sheet for details of your right to appeal.

Yours sincerely
