I am seeking information about the number of fines that were wrongly issued for non-payment of the Ultra-Low Emission Zone (ULEZ).
Specifically, can you tell me:
- How many Penalty Charge Notices (PCNs) for non-payment of the ULEZ have been successfully appealed by vehicle owners on the grounds that their vehicle was ULEZ compliant?
- Please provide this data broken down by month from May, 2019, when fines were first issued for non-compliance, to the latest available date.

Thank you for your email received by Transport for London (TfL) on 25 February 2020.
Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold the information you require.
Unfortunately, to provide the information you have requested would exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees Regulations 2004). Under section 12 of the FOI Act, we are not obliged to comply with a request if we estimate that the cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit. This is calculated at £25 per hour for every hour spent on the activities described.
While we do record the reasons representations are submitted, we are currently experiencing a technical issue which is preventing us extracting this data from our systems. We are working to resolve this but do not currently have a date when this information will be available.
In order to locate and retrieve representations that were made on the grounds that the vehicle was ULEZ compliant, we would need to manually review each individual representation and extract and collate any that met the requirements of your request. Please see the below table for the number of representations we have received since 8 April 2019 which outlines the thousands of individual files we would need to review. Such a process would take considerably more than 18 hours and so exceed the cost limit outlined above.
