Our ref: FOI-3523-2223/GH Thank you for your request received by Transport for London (TfL) on 28 March 2023 asking for information about staff TUPED into Technology and Data and Technology Service Operations. You asked: Under the Freedom of Information ACT, can you please provide me with the number of External employer, Computer Science Corporate (CSC) employees TUPE to LUL/TFL 2008/2009, who still remain on TUPE protection and have not signed TfL Contract of Employment, Terms and Conditions. Can this information, please be broken down by Directorate, Department, Section and payband. Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold the information you require. There are 10 External employer, Computer Science Corporate (CSC) employees who were TUPE to LUL/TFL 2008/2009 and are still employed. Of these, five signed TfL T&Cs on transfer, two have signed TfL contracts since due to promotion. There are therefore three remaining who still remain on TUPE protection and have not signed TfL Contract of Employment, Terms and Conditions. Due to the low number of employees concerned, we are unable to disclose the Directorate, Department, Section and payband as requested, as this would allow individuals to be identified. This information is exempt from disclosure in accordance with TfL’s obligations under Data Protection legislation and as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.
