Thank you for your request received by Transport for London (TfL) on 23 March 2023 asking for information about ULEZ data.

Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold the information you require.
 
  1. Please could you advise how the data was collected, including what network of cameras were used, to determine 9 out of 10 cars driving in Outer London are ULEZ compliant, as per TFL's claim dated 23/3/23

We use available data from our network of Automated Number Plate Recognition (ANPR) cameras data to monitor the ULEZ compliance of cars and other vehicles driving in London.  We monitor the daily number of unique vehicle detections using pseudonymised ANPR data which is cross referenced with available DVLA records in order to check if a vehicle is compliant with the ULEZ standards or not. 2) Please could you advise what legal permissions are relied upon to collect this data
TfL has used ANPR cameras to monitor and enforce Road User Charging schemes such as the Congestion Charge, Low Emission Zone and Ultra Low Emission Zone in London for many years. TfL has completed Data Protection Impact Assessments (DPIAs) of the expansion of ULEZ which took place in 2021 and of the forthcoming expansion in August 2023 which set out how the scheme operates in accordance with data protection legislation and in particular how we minimise data collection from ANPR cameras, how data will be used and how we keep it secure. The legal basis for our processing of the personal data collected by the ANPR cameras, including for the monitoring and analysis referred to above, is Article 6 (1) (e) of the UK GDPR – “The Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.” More information in this regard - including copies of the DPIAs referred to above - can be found on our website here: https://tfl.gov.uk/corporate/privacy-and-cookies/road-user-charging
