Thank you for your request received by Transport for London (TfL) on 14 February 2020 asking for information about a summary of our Business Plan published in 2018.
Your request has been considered in accordance with the requirements of the Freedom of Information (FOI) Act and our information access policy. I can confirm we do hold the information you require.
The information you asked for is available on our website using the following link: http://content.tfl.gov.uk/fc-20181213-item07-tfl-business-plan-approval.pdf which is from our Finance Committee papers from 13 December 2018. The presentation slides start from page 5.
In accordance with section 21 of the FOI Act, we are not obliged to supply you with a copy of the requested information as it is already accessible to you elsewhere.
Section 11(1)(a) of the FOI Act states the following:
Where, on making his request for information, the applicant expresses a preference for communication by any one or more of the following means, namely—
(a)the provision to the applicant of a copy of the information in permanent form or in another form acceptable to the applicant,
the public authority shall so far as reasonably practicable give effect to that preference.
However s11(3) and s11(4) of the FOI states:
s11(3) - Where the public authority determines that it is not reasonably practicable to comply with any preference expressed by the applicant in making his request, the authority shall notify the applicant of the reasons for its determination.
s11(4) - Subject to subsections (1), a public authority may comply with a request by communicating information by any means which are reasonable in the circumstances.
We do not believe that it is reasonably practicable to print off and send the business plan summary paperwork in the post because the requested information is readily available on our website using the link we have provided.
The primary reason we publish information and minutes on our website is to improve accessibility to members of the public and to minimise the amount of time and resource it was taking to issue these individually in response to FOI requests.
