Isle of Dogs Charging Rates

We request information related to the charging rates proposed to be applied to Isle of Dogs under the Mayoral Community Infrastructure Levy 2 ("MCIL2") held by Transport for London ("TfL") pursuant to the Freedom of Information Act 2000 ("Act"). Specifically, please provide us with the following information in accordance with section 1 of the Act: a) any correspondence during the period of June 2016 to December 2017 between Mr Julian Ware of TfL and Messrs Richard Jones and Ryan Gerrish of Jones Lang LaSalle Inc. ("JLL") regarding the charging rates proposed to be applied to Isle of Dogs under the MCIL2 charging schedule; and b) any correspondence during the period of June 2016 to December 2017 between Mr Julian Ware of TtL and Messrs Richard Jones and Ryan Gerrish of JLL regarding the charging rates proposed to be applied to Isle of Dogs under the MCIL2 charging schedule and how they compare to the charging rates proposed to be applied to comparative development areas including, for example, Stratford and Old Oak Common.

Thank you for your clarified request received on 27 March 2019 asking for information about the charging rates proposed to be applied to Isle of Dogs.
 
Your request has been considered in accordance with the requirements of the Freedom of Information Act 2000 (FOIA) and TfL’s information access policy. I can confirm we do hold the information you require.
 
We have estimated that it would cost over £450 to provide a response to your current request. This is because it is estimated that it would take longer than 18 working hours to retrieve and compile the information you have requested.  Unfortunately, to provide the information you have requested would therefore exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004. This is calculated at £25 per hour for every hour spent on the activities described. In accordance with Section 12 of FOIA, in cases such as this one, where the estimated cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit, we are not obliged to comply with the request. 
 
When requests for email correspondence are received, the FOI Case Management team may use a search tool called Discovery Accelerator. This allows us to conduct company wide email searches using keywords, dates and email addresses. The more specific a requester can be as to what they are looking for, the more we can narrow the search and therefore improve the prospect of obtaining a more relevant or focused result. A search will then return an amount of ‘hits’ which potentially contain information relating to the search terms used. Each ‘hit’ is a single email, although that email will often consist of a chain of emails containing the search term at least once. We have carried out an initial search for all emails held by TfL sent/received by Julian Ware with Richard Jones and Ryan Gerrish of JLL, using the search term ‘MCIL2’. This has resulted in 331 hits. We would now need to extend the search to include additional keywords such as ‘charging rates’ or ‘rates’ to ensure we locate everything captured by your request. Whilst a number of these emails will be duplicates, we would still need to manually review all of the emails identified by the search in order to extract and collate the relevant emails.
 
To help bring the cost of responding to your request within the £450 appropriate limit, you may wish to consider narrowing its scope so that we can more easily locate, retrieve and extract the information you are seeking, for example by narrowing the time period you have requested or providing further keywords that we can search against.
 
If you want to refine your request or make a FOIA request in future, please bear in mind that FOIA allows you to request recorded information held by Transport for London. You should identify the information that you want as clearly and concisely as you can, specifying the types of document that you are looking for.
 
Although your request can take the form of a question, rather than a request for specific documents, TfL does not have to answer your question if it would require the creation of new information or the provision of a judgement, explanation, advice or opinion that was not already recorded at the time of your request.
 
In light of the above, please note that we will not be taking further action until we receive your revised request.
