Following up on data provided by the Mayor of London on 27 December 2018 in response to Mayoral Question 2018/2658 (https://www.london.gov.uk/questions/2018/2658) a 17 July 2018 email from TfL’s General Council to Director of Rail, copied to the Managing Director of Surface Transport, HSE Director, and Corporate Secretary mentions emails sent by SSHR Panel Chair received “over the weekend” (i.e., 14-15 July 2018) and also “comments provided last week” from the SSHR Chair (i.e., week of 9-13 July 2018).
1. Please provide me with copies of all communication received from the SSHR Panel Chair from 9 July to 17 July 2018 referred to in this 17 July 2018 email.
2. Please provide me with copies of all communications from the Commissioner of Transport and the Deputy Mayor for Transport concerning this communication from the SSHR Panel Chair.

Thank you for your request received on 5 March 2019 asking for copies of communication about the Croydon Tram Crash Investigation.
Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we hold some of the information you require. You asked for:
1. Please provide me with copies of all communication received from the SSHR Panel Chair from 9 July to 17 July 2018 referred to in this 17 July 2018 email.
In accordance with TfL’s obligations under Data Protection legislation this information has been withheld, as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle of Article 5 of the General Data Protection Regulation which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.
This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption.
2. Please provide me with copies of all communications from the Commissioner of Transport and the Deputy Mayor for Transport concerning this communication from the SSHR Panel Chair.
We do not hold the information requested. Communications between TfL and the Deputy Mayor for Transport in relation to the Board paper was between TfL General Counsel and the Deputy Mayor on 24 July 2018 at 14:41, 15:57 and 17:02 and were included in the previous data provided in response to MQ2018/2658.
