Between now and work commencing on CS9, what further approvals are needed? Thank you for your request received by Transport for London (TfL) on 17 February 2019 asking for information about CS9. Please accept my apologies for the delay in our response.

Your request has been considered in accordance with the requirements of the Environmental Information Regulations and our information access policy. I can confirm we hold some of the information you require. For ease of reference we have addressed each question as outlined in your request. You asked:

How much money will be spent by TfL on the introduction and operation of CS9?

£51m

How much money will be or has been received by London Borough of Hammersmith & Fulham from TfL or any other body to assist with the introduction of CS9? 

To date, London Borough of Hammersmith & Fulham has received £314k funding for CS9 from TfL. Future funding is to be agreed upon normal cost estimation processes.

Given the experience of the East West Cycle Superhighway, which has caused ~ 400 working hours to be lost every day (https://www.bbc.co.uk/news/uk-england-london-46359391), what study on costs vs benefits of the new route has been done and what does it show?

What assessment has been made by TfL on the likely use of CS9 by bicycles in its first year of operation and what %age uplift on cycling will this be? What data or other information has been considered as the benchmark to model any increase in cycling and what is the evidence base for any projected increases?

Given that the trend towards cycling in London peaked in 2011, what consideration was given to the possibility that the construction of CS9 might result in no increases or only minimal increases in cycling within the borough?

Given that the experience on the cycle superhighway from Tower Hill to Lancaster Gate has been that there are just 754 more riders per day and that the scheme has therefore cost over £62,000 for every cyclist attracted to the route (http://www.cityam.com/263269/boris-johnsons-flagship-cycle-superhighway-costs-62000), what evaluation has been made by TfL on the likely value for money of introducing CS9 in the borough?

Please find attached the version of the Equality Impact Assessment (EqIA) prepared prior to the publication of the Response to Issues Raised report in January 2019.  TfL complies with the Public Sector Equality Duty by having due regard to the matters set out in section 149 Equality Act 2010.  EqIAs are iterative documents and in developing its proposals for this scheme to the next stage, TfL will continue to take into account any potential impacts on those with protected characteristics and the need to ensure that their interests are taken into account and that any adverse impacts are mitigated so far as is possible and reasonable. This is a continuing duty and as such we will keep any impacts on protected groups under review as the scheme progresses. An updated version of the EqIA is currently in development and any further issues identified since the Response to Issues Raised will be reflected in that.  A comprehensive EqIA will be taken into account by TfL as part of the decision-making process leading to the start of construction.  In addition to our Equality Act duties, we comply with established national guidance which includes detailed requirements for disabled people. The EqIA is provided in answer to the question above and sub-questions below.

TfL takes decisions in accordance with the Scheme of Delegation and authorities set out in its Standing Orders, which are publicly available.  The Standing Orders are kept under review to reflect organisational changes. Prior to the start of construction, there is currently expected to be at least one further stage of internal consideration and approval.  This is currently expected to follow consideration at a meeting of senior officers in October 2019.

Between now and work commencing on the implementation of CS9, what action could be taken that would delay the introduction or stop it?

TfL does not hold information falling within the scope of this part of the request.

Please note that in accordance with TfL’s obligations under the Data Protection legislation some personal data has been removed, as required by Regulation 13 of the Environmental Information Regulations. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle of the legislation, which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 which would make the processing ‘fair’.
