Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.  I can confirm we do hold the information you require. You asked:

1) Is London Underground Occupational Health (LUOH) recommendation a pre-requisite for ill health pension to be granted for an LUL employee?

2) Can an LUL employee be granted ill health pension If LUOH considers an employee is not eligible for ill health pension ?

While TfL takes into account medical evidence provided by the London Underground Occupational Health (LUOH) along with other medical evidence under the process to ascertain whether a member qualifies for an ill health pension under Rule 19(1), LUOH’s role is not to recommend a member be granted an ill health pension. The Trustees have an independent medical advisor who reviews the medical evidence and provides advice as to whether, based on the medical evidence from all sources, a member would qualify for an ill health pension under the Fund Rules.

3) How many employees were granted ill health pension during the last 5 years without recommendation from LUOH?

A total of 473 employees.

4) Please provide copy of Rule 19(1) covering ill health pension.
