Thank you for your request received by Transport for London (TfL) on 18 February 2023 asking for copies of all drafts of the report "London-wide ULEZ Integrated Impact Assessment (ULEZ Scheme IIA)” carried out by Jacobs.
Your request has been considered under the requirements of the Environmental Information Regulations (EIR) and our information access policy. You asked: Please could I have copies of all drafts of the report "London-wide ULEZ Integrated Impact Assessment (ULEZ Scheme IIA)” carried out by Jacobs.
The draft versions of the final London-wide ULEZ Integrated Impact Assessment (IIA) referred to in the final IIA are each incomplete documents which were solely used by Jacobs and TfL to inform the final version of our published IIA, and as such this information is subject to an exception from disclosure in accordance with Regulation 12(4)(d) which applies to information which is still in the course of completion, unfinished documents or incomplete data.
The draft versions we hold are, by definition, unfinished and therefore we consider the exception to be engaged.
The use of this exception is subject to a public interest test, which requires us to consider whether the public interest in applying the exception outweighs the public interest in disclosure. We recognise that the release of information would promote transparency and also help address your particular concerns about this issue. However, on balance, we consider that the public interest is already suitably satisfied by the publication of the completed document that is available for consideration and scrutiny as applicable. Release of the incomplete information would prejudice our ability to develop, challenge and refine proposals in a safe space before submitting them to public scrutiny and we do not consider that the public interest is best served by this and therefore favours the use of the exception.
