You asked

The total amount paid to SocietyWorks for the FixMyStreet service for the current contract period by the TFL. A breakdown of the services and solutions included within this payment. Thank you for your request which we received on 15 November 2023, asking for information about Fix My Street contract.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.  I can confirm that we hold some of the information you require. You specifically asked for:
  1. The total amount paid to SocietyWorks for the FixMyStreet service for the current contract period by the TFL
This is £117,300 over the three year initial term (£39,100 per annum), with an option to extend by an additional year (£39,100) for combined value of £156,400. Please see the plans and pricing document attached.
  1. A breakdown of the services and solutions included within this payment.
TfL receives the Advanced FixMyStreet Pro product as outlined by the attached at £46,000 per annum. This price TfL pays is a 15% reduction on this by virtue of TfL having a 5+ year continuous agreement in place with SocietyWorks. For more information, please see the service document attached.

Please find the contract ‘RM1557.13-G-Cloud-13’ with an appendix 3 attached.

However, we are not obliged to supply the service level agreement (SLA) and cyber requirements appendices as they are subject to a statutory exemption to the right of access to information under sections 43(2) and 31(1)(a) of the FOI Act.

Section 43(2) Commercial Interests protects against prejudice to commercial interests. The disclosure of SLA could give an insight into how the value of this agreement was reached and would be likely to prejudice our commercial interests, as well as SocietyWorks. Prejudice would be likely to occur if we were to seek similar services or SocietyWorks were to compete for similar tendering opportunities in the future, by affecting their ability to achieve best value from negotiating future contracts.

Section 31(1)(a) Law Enforcement relates to information whose disclosure would be likely to prejudice the prevention or detection of crime. In this instance the exemption has been applied as disclosure of TfL’s cyber requirements would pose a real threat to our IT systems, and consequently, the prevention or detection of crime as it would assist a third party to mount an attack on our IT systems. It is the sort of information that could be combined with other information available to an attacker or already in the public domain, to target our systems.

The use of these exemptions is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognise the need for openness and transparency by public authorities, but in this instance the public interest in ensuring that we are able to benefit the public purse by achieving the best value from our contractors and safeguard our information systems to ensure that cyber-attacks, or any other criminal activity is prevented, outweigh the general public interest in increasing transparency of our processes.

Please note that in accordance with TfL’s obligations under Data Protection legislation all personal data has been removed, as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.

This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption.

  1. Information on how the council measures the effectiveness of the FixMyStreet service.
Firstly, I would like to clarify that TfL is a local government body, not a council.

The Fix My Street service increased the number of fault reports being raised and sent directly to the response desk for handling, averaging 2,000 fault reports per period. It also helps with better quality of location-based data and our ability to spot and act on trends.
