You asked

I would like to request information regarding an incident at Charing Cross Underground Station on January 8th 2018, during which a man was seriously injured on one of the platforms. I would like to know: 1) The reason for the injuries. 2) Whether the man died as a result of his injuries. 3) Whether the police were called to the scene. 4) Whether the incident has received any news coverage. I just wanted to update my FOI request. The incident occurred near ticket barriers, not on one of the platforms. If you could amend my FOI request accordingly that would be appreciated.

Thank you for your follow-up request received by Transport for London (TfL) on 26 January 2018 asking for information about an incident at Charing Cross station on 8 January 2018.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. You asked:

1) The reason for the injuries
We are not obliged to provide this information. This is done in accordance with TfL’s obligations under the Data Protection Act 1998 (DPA), as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the DPA, specifically the first principle of the DPA which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 of the Data Protection Act which would make the processing ‘fair’. This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption

2) Whether the man died as a result of his injuries.

We do not hold this information.

3) Whether the police were called to the scene.

We have no record of the Police being called or attending the scene.

4) Whether the incident has received any news coverage.

We have no record of this incident receiving news coverage.
