You asked

I am writing to obtain the following information under the Freedom of Information Act. I would like copies of all letters where Cross Rail 2 or TFL acting for Crossrail 2 have replied to any Local Planning Authority in relation to any planning application referral for any form of residential development that was outside the current safeguarding zone set by the Secretary of State for Transport on the 24th March 2015. This information is not being requested to further any commercial purpose.

We answered

Our Ref:          FOI-2937-1718

Thank you for your request received on 14 January 2018 asking for information about Crossrail2.

Your request has been considered in accordance with the requirements of the Environmental Information Regulations (EIR) and our information access policy. I can confirm we do hold the information you require.

There have been six cases where Transport for London (TfL) has made a representation to the Local Planning Authorities in relation to residential developments outside of the current Safeguarding Directions, issued March 24 2015.

These cases are below. Copies of the letters sent to Local Planning Authorities can be found in the attached PDF document. Whenever a planning authority receives an application in close proximity to the Safeguarded Directions, we encourage applicants to discuss their plans directly with us.

Please note that in accordance with TfL’s obligations under the Data Protection Act 1998 (DPA) some personal data has been removed, as required by regulation 13 of the EIR. This is because disclosure of this personal data would be a breach of the DPA, specifically the first principle of the DPA which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 of the Data Protection Act which would make the processing ‘fair’.

This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption.
