Thank you for your request received by Transport for London (TfL) on 12th November 2023 asking for information about a “Notification of Prohibited Use" letter dated 21st April 2023.
Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.
Specifically you asked:
“A 'TikTokker' under the profile name of 'xxxx' (also known as 'xxxx' or his legal name 'xxxx') publicized a letter from Transport for London titled "Notification of Prohibited Use" dated xxx3. This letter was publicized on a TikTok post on xxx.
Could you please confirm whether you hold this letter mentioned above, and if so could you please confirm whether you hold any letter in response?”
The requested information is exempt from disclosure under section 40(2) of the Freedom of Information Act, the exemption that protects against the unfair release of personal data, and we neither confirm nor deny whether the requested information is held. Where an FOI request relates to an identifiable third party, and where release of information is considered unfair, there is no obligation for the information to be disclosed. We do not believe that disclosing the details of correspondence we may have had with third parties would be fair, nor do we believe that correspondents would expect their information to be disclosed in this way. For those reasons the exemption applies.
