Number of appeals made concerning Claps Lane Retail Park

You asked

Please could you let me know how many PCNs have been issued for contraventions at the Claps Lane Retail Park? Could you also say how many of those were appealed against on the grounds of insufficient signage and information about the need to pay the ULEZ charge upon entering the retail park.

Thank you for your request received by Transport for London (TfL) on 15 March 2022 asking for information about the number of appeals made concerning Claps Lane Retail Park.

Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold the information you require.

Signage was installed and in use in advance of the ULEZ expansion being implemented. Early warning signage was installed at entrances to the zone between July and September, explaining the ULEZ was coming on 25 October 2021.  This was replaced at go-live by permanent road signs at every entry point along the boundary and along key arterial approaches.  More than 400 repeater signs were also installed inside the zone close to every boundary point and on main roads throughout the zone. Additionally we had a media campaign to make drivers aware of their responsibilities when driving in London. All the information about the ULEZ and the area it covers is on our website along with the standards and details of how to pay the daily charge.

Following the expansion of the ULEZ, warning notices were issued to non-compliant vehicles seen using the zone in the first four weeks after expansion - i.e. between 25 October and 22 November 2021. Penalty Charge Notices (PCNs) were issued for contraventions from 23 November 2021. Warning notices were issued to ensure the correct action is taken in the future and to allow for any genuine mistakes that may have occurred.

In order to challenge a penalty the recipient must first submit a representation to TfL. If the representation is accepted the penalty is cancelled. If we reject the representation the motorist has a further right of appeal to an Independent Adjudicator at London Tribunals. If the appeal is refused the penalty remains open, if it is allowed the penalty is cancelled.

A vehicle may be captured by many cameras within the zone and we use the best quality images for purposes of issuing a PCN. The total number of ULEZ PCN’s issued for the cameras situated at this location since 23/11/2021 to 17 March 2022 is 2,089.

Of the representations received against these, we received one stating ‘Signage/Road Markings Disputes’ and this was rejected. A further 16 representations were received on the grounds that the motorist was unaware of the ULEZ or how it operates. These were all rejected.
