TfL Ref: 2821-1819
Thank you for your email of 24th January 2019 asking for the presentation decks, agenda and minutes from the taxis and private hire quarterly compliance review meeting of 23rd January 2019.
Your request has been considered in accordance with the requirements of the Freedom of Information (FOI) Act and our information access policy. I can confirm that we hold the requested information. However, it is being withheld under section 22 of the FOI Act. Section 22 provides an exemption to the release of information where it is due for publication at some future date and where, in all the circumstances of the case, it is reasonable to withhold it until publication. This is a ‘qualified exemption’, meaning that its use is subject to a ‘Public Interest Test’ to determine whether it is in the greater public interest to apply the exemption and withhold the information or to release it prior to publication anyway.
In considering the public interest we recognise the expectation of openness and transparency placed on public authorities by the FOI Act. However, in this case that expectation is met through the routine publication of the requested material, past examples of which can be found on our website here: https://tfl.gov.uk/info-for/taxis-and-private-hire/private-hire-meetings?intcmp=48647. The documents from the meeting of 23rd January 2019 will be posted on this section of the website shortly – I understand that this will be done within a matter of weeks. The guidance from the Information Commissioner on the use of the section 22 exemption states that, “The closer to the date of publication, the more reasonable it is likely to be for the public authority to withhold the information until publication has taken place.” Given the FOI Act allows twenty working-days for requests to be answered (which in the case of your request is the 21st February 2019), it will only be a very short period of time to wait beyond that deadline until the information can be sourced from our website. We therefore believe that it is reasonable to apply the exemption in this case, and for the information to be issued in line with our planned processes.
Please see the attached information sheet for details of your right to appeal.
Yours sincerely,
David Wells
