You asked

I am writing to request an internal review of Transport for London's handling of my FOI request 'Dates of safety audit on Bus Operators'. You said "We also conduct quarterly health and safety assurance visits with all bus operators", can i please have these dates and which bus operator visits? Thank you for your requests reference numbers above asking for various information relating to buses and safety.

Your requests has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we do hold some of the information you require.

However, in accordance with section 12 of the FOI Act, we are not obliged to comply with a request if we estimate that the cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit. This is calculated at £25 per hour for every hour spent on the activities described.

Under Regulation 5(2) of the Data Protection and Freedom of Information (Appropriate Limits and Fees) Regulations 2004, we are permitted to aggregate requests where they relate to any extent to the same or similar information and this aggregation applies to any requests that are received within a sixty working day period.

We consider that the cost of complying with your latest four requests, on top of the 9 FOI requests which we have received from you between the dates of 31 October 2018 and 28 January 2019, would exceed the cost limit. This would be exceeded further if we were to consider any other associated requests from you in the forthcoming days and weeks. Therefore we are refusing the above requests which we have not answered as yet.

We estimate that we have processed around forty requests from you in the last twelve months. We suggest that, before submitting future requests, you consider which information is of the highest priority to make best use of the processing time within the FOI Act described above. Similarly, please be aware that requests that are to any extent similar that we have identified as being submitted from individuals working in concert will be considered together for the purposes of calculating the cost limit. Therefore, we recommend submitting single, complete requests for information across the full timeframe rather than splitting questions amongst different requests or individuals as this will not circumvent the cost limit.
