Thank you for your email received by us on 31 December 2017 asking for information about Yellow Box Junction Locations.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.  I can confirm that we hold the information you require.  You asked:

“Please kindly provide me with a list of the locations of the Yellow Box Junctions:
1. You enforce with CCTV.
2. You plan to start enforcing with CCTV over the next 2 years.”


In accordance with the FOI Act, we are not obliged to provide the information you seek regarding CCTV enforcement at yellow box junctions as this information is subject to a statutory exemption to the right of access to information under section 31(1)(b) and Section 31(1)(g), which exempt from disclosure information which would, or would be likely to prejudice the apprehension or prosecution of offenders or the exercise of functions for the purpose of ascertaining whether any person has failed to comply with the law.

A disclosure made under FOI is deemed to be a disclosure ‘to the world at large’. By disclosing a list of the locations of yellow box junctions which are currently monitored by CCTV would, by default, provide a public knowledge of any yellow box junctions which are not currently enforced. This would be likely to lead to a decrease in compliance with traffic restrictions at those locations, which would adversely affect the flow of traffic on the network and impact on TfL’s Network Management Duty.

The purpose of enforcement is to deter drivers from contravening restrictions that are in place and PCNs are issued accordingly. Any increase in traffic congestion or a decrease in compliance additionally carries a risk to the safety of all road users but in particular to pedestrians.  Even where safety of users is not a factor, increased contraventions by a minority will be at the detriment to the majority of law abiding road users who need to use the network, who deserve to get the most congestion free network we can offer.

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognise the need for openness and transparency by public authorities, but in this instance feel that balance lies in favour of withholding the information to ensure that we are able to continue to comply with our Network Management Duty while ensuring the safety of the traveling public to the best of our ability.
