It is understood that Deloitte were awarded contract TfL 93601, to provide TUPE and reorganisation support to TfL Engineering Transformation as per the specification provided by LUL/TfL. Please can you provide me with the following information in relation to this contract and any variations or subsequent related new commissions? • The dates on which the contract, variations or subsequent related new commissions? Were awarded • The method by which this contract, variations or subsequent related new commissions were awarded, e.g. called off under an existing framework contract, by competitive tender or by single source justification] • If by competitive tender, the invitation to tender documentation and the names of the competing organisations and the final shortlisting and scores • The requirements specification for the work to be delivered by this contract, variations or subsequent related new commissions • The documentation issued to TfL and its subsidiary companies by Deloitte under this contract, variations or subsequent related new commissions awarded. This is with reference to the materials provided during the course of the contract tender or single source process • Whether or not any of the work under this contract or single source has recommended headcount reduction. Thank you for your request received on 28 December 2017 asking for information about the contract with Deloitte.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we hold some of the information you require.

The Mayor’s vision included a commitment to merge engineering functions within TfL and create a single Engineering Directorate. The scope of the Engineering transformation, the first in our history, covers all areas of TfL where engineering capability is deployed or procured to deliver services to operate, improve and deliver transport infrastructure, and transport systems. This merger will identify further efficiencies to support the TfL business plan.

You asked:

• The dates on which the contract, variations or subsequent related new commissions? Were awarded

Contract awarded on the 20 February 2017. Expiry date of the Contract is 27 July 2018. Variation 01 added to include Phase 2 – signed on 5 January 2018.

• The method by which this contract, variations or subsequent related new commissions were awarded, e.g. called off under an existing framework contract, by competitive tender or by single source justification]

By competitive tender via the Crown Commercial Services Frameworks (CCS) – Consultancy One Framework – RM1502.

• If by competitive tender, the invitation to tender documentation and the names of the competing organisations and the final shortlisting and scores

In accordance with the FOI Act, we are not obliged to supply the requested information as it is subject to a statutory exemption to the right of access to information under section 43(2).

In this instance the section 43(2) exemption has been applied to Deloitte’s response to the tender as disclosure would be likely to prejudice our commercial interests as well as those of Deloitte. Prejudice would be likely to occur when we go out to tender for this and similar services in the future, because it would be likely to result in a clustering of bids based on how much we are prepared to pay. Disclosing this information could also be prejudicial to Deloitte’s ability to compete for tendering opportunities with us and other companies in the future, as their competitive edge would inevitably be prejudiced by disclosure of detailed information about how they meet the requirements of the ITT as well as a detailed breakdown of their price.

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognise the need for openness and transparency by public authorities but in this instance the public interest in ensuring that we are able to obtain the best value for public money outweighs the general public interest in increasing transparency of our processes.

Deloitte are the delivery partner for the engineering transformation. Deloitte have advised and supported TfL with methodology to size the organisation but have not specifically recommended headcount reductions. This was undertaken by TfL.

• Whether or not any of the work under this contract or single source has recommendations for an engineering operating model, including any steps that must be taken to achieve this model with recommended timelines, if available

As above, Deloitte are the delivery partner for the engineering transformation. Deloitte have advised and supported TfL with methodology to determine the operating model for the organisation but have not specifically recommended an operating model. This was undertaken by TfL.

• The number of full time equivalent staff provided by Deloitte to work on this contract

Varies depending on the different phases of the transformation. Between 10-20 heads.

• Whether or not the contract has expired

The Contract will expire on 27 July 2018.

• If the contract has expired, whether or not it has been extended or transferred to another contract, such that Deloitte are still engaged in supporting the transformation programme
