In accordance with the Freedom of Information act, please could you disclose any additional payments and their terms agreed between contractors working on central stations and Crossrail Ltd outside of the original contract terms.

Thank you for your requests received on 15 January 2019 asking for information about Crossrail contract payments.
Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we do hold the information you require.
In accordance with the FOI Act, we are not obliged to supply the requested information as it is subject to a statutory exemption to the right of access to information under section 43(2).
Disclosure of any amounts already paid could further prejudice Crossrail Limited’s (CRL) commercial interests because it would be likely to result in a clustering of claims based on how much has already been paid. CRL’s forecast of the final cost of on-going contracts reflects our assessment of the likely outcome of commercially sensitive issues with the contractors which are currently under management by CRL’s delivery and commercial teams. The expected completion dates for on-going contracts and CRL’s forecast of the final cost of on-going contracts depends on the resolution of these issues and therefore at the present time disclosure of this information is likely to lead to an increase in costs.
The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. In this instance, it is considered that factors in favour of disclosure, such as the general public interest in transparency and openness, are outweighed by the public interest in CRL being able to effectively manage the remainder of the Programme so as to obtain best value when spending public money. Please also be aware that CRL will publish full details of the final cost of all contracts at the conclusion of the Crossrail Programme so we will make this information freely available when the concerns outlined above do not apply.
