Dear Sir/Madam, Re: Freedom of Information Request We are writing from xxxxSolicitors, with company number xxxx to make a freedom of information request. We act for xxxx in a claim for damages against his former employer, xxx Ltd. We request formally on xxxx's behalf details of any reported accidents made by xxx Ltd to the London Underground Limited, between the years 1991 and 2016. We make this request under the Freedom of Information Act, which states that we have the right to access any recorded information held by public organisations. We stress that this is a very important and urgent request that we are making to you because we are expecting to be in trial very soon. If you are able to help us, please can you contact us on xxxx, and please can you ask to speak to xxxx.

TfL Ref: 2664-1920

Thank you for your request received by Transport for London (TfL) on 2 December 2019 asking for details of any reported accidents made by xxxx Ltd to the London Underground Limited, between the years 1991 and 2016.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.  I can confirm that we hold some of the information you require. Although you have asked for data back to 1991, we only hold data going back as far as 2006.   Please find attached a list of all the incidents that we have been able to locate where xxxx is given as the Contractor/Subcontractor.  To be clear, the term ‘accidents’ is very broad and generic in nature. If you are in search of just ‘injuries’ then this data can be filtered using Column B.

           

Please note that in accordance with TfL’s obligations under Data Protection legislation some personal data has been removed, as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.
