I would like to request information on any contracts tied in to the ULEZ expansion that are binding to the GLA and/or TfL. * How long is the contract with the supply and service of the Siemens Yunex ANPR ( currently Secore II camera - with any updates or any upgrades) ? * How much is the total price/value in that contract. * Is there any Penalty Clauses if TfL/GLA wanted to exit this contract and how much are they ? * Are there any other contracts tied in to this use of these ANPR as or tied in alongside the ULEX expansion - such as further upgrades in emissions output or pay per mile or average speed checks..? * Is there any contracts with any company to decider the information from these cameras then send this to the enforcement team..? If so how long is this contract and how much is it’s value and is there any exit penalties should the GLA/ TfL wish to exit early and how much are they ?

Thank you for your request which we received on 23 October 2023, asking for information about the ULEZ contract.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.  I can confirm that we hold the information you require. You specifically asked:
 
* How long is the contract with the supply and service of the Siemens Yunex ANPR (currently Secore II camera - with any updates or any upgrades) ?

Ten years.

* How much is the total price/value in that contract.

The contract is a framework and not specific to the London-wide ULEZ, it’s used for a variety of capital works so we place orders for projects as and when needed. The value of the contract is between £60m-£600m. More details can be found here:

* Is there any Penalty Clauses if TfL/GLA wanted to exit this contract and how much are they ?

Yes. However, in accordance with the FOI Act, we are not obliged to supply this as it is subject to a statutory exemption to the right of access to information under section 43(2). In this instance the exemption has been applied as disclosure of the information you have requested is commercially sensitive as it is specific to contractual mechanisms between us and Siemens (now Yunex). Disclosure would, or would be likely to prejudice ours as well as their commercial interests. Releasing the specific details regarding the penalty clauses contained within the contract would allow competitors to understand the pricing strategy which would hinder them in any tenders for similar contracts in the future, as well as hinder our own ability to negotiate the best value for money for similar services in the future.

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned.  We recognise the need for openness and transparency by public authorities, but in this instance the public interest in ensuring that we are able to obtain the best value for public money outweighs the general public interest in increasing transparency of our processes.

No.

* Is there any contracts with any company to decide the information from these cameras then send this to the enforcement team..?

Yes.

If so how long is this contract and how much is it’s value and is there any exit penalties should the GLA/ TfL wish to exit early and how much are they ?

Ten years, and the value of the contract is £639.5m. In accordance with the FOI Act, we are not obliged to supply details regarding the penalty clauses as they are subject to a statutory exemption to the right of access to information under section 43(2). The same arguments as above apply to our decision not to disclose this information.
