In relation to PCN _______ I would like to know how many PCNs have been issued for parking contraventions Location O/S 142-152 STOKE NEWINGTON HIGH STREET N16, for Stopped where prohibited (on a red route or clearway) in the last 5 years? How many were from CCTV and how many were ticketed? How many were challenged on appeal? and how many appeals were successful?

Thank you for your request received by Transport for London (TfL) on 23 October 2023 asking for information about Penalty Charge Notices and subsequent appeals.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. You asked:

In relation to PCN _______ I would like to know how many PCNs have been issued for parking contraventions Location O/S 142-152 STOKE NEWINGTON HIGH STREET N16, for Stopped where prohibited (on a red route or clearway) in the last 5 years? How many were from CCTV and how many were ticketed?

I can confirm that we hold the information you require. However, in accordance with the FOI Act, we are not obliged to supply the information requested above, as it is subject to a statutory exemption to the right of access to information under section 31 of the FOI Act, which relates to law enforcement. Specifically, we are refusing your request under section 31(1)(b), which relates to information whose disclosure would be likely to prejudice the apprehension or prosecution of offenders, and section 31(1)(g), which relates to information whose disclosure would be likely to prejudice the exercise by any public authority of its functions or any of the purpose of ascertaining whether any person has failed to comply with the law.

Disclosure under the Freedom of Information Act is considered to be a disclosure ‘to the world at large’ rather than the individual applicant. Whilst we make no suggestion that you would use the information for anything other than your own personal interest, in this instance the exemption has been applied as information regarding enforcement on the Transport for London Road Network could be used by people wishing to build knowledge of TfL’s enforcement activities to avoid PCN’s.  

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognise the need for openness and transparency by public authorities, but in this instance feel that balance lies in favour of withholding the information to ensure that drivers in London use the roads in compliance with the relevant restrictions and that we are able to manage traffic on the road network. It would be strongly against the public interest to release any information that would undermine this.

How many were challenged on appeal? and how many appeals were successful?

However, we can advise that of the PCNs issued, we received 1,132 representations. Of these, 528 were accepted, 431 were rejected and 173 remain open. Of the 431 we rejected, 57 appeals were submitted to London Tribunals.  Of these, 4 were allowed, found in favour of the appellant.

Once in that page, click “Search” under the section “Environment and Traffic Adjudicators (ETA)”. On that page, in the “Enforcing Authority” box, enter “Transport for London” and set the data ranges of interest.

In the meantime, on receipt of a Penalty, a motorist has the right to challenge it by submitting a representation to us. If this is accepted the penalty is cancelled. If rejected the penalty remains payable and a further right of appeal to an independent adjudicator at London Tribunals is granted.
