Thank you for your further request of 11th February 2022 asking for information about TfL property disposals.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. 

Specifically you asked:

Please widen search to sale prices of TFL disposals of property under 1.00 acres in size that have been carried out in the boroughs of brent, ealing, lewisham, islington, westimister and Lambeth  from 2019-2021.”

I can confirm that we hold the information you require - this is provided in the attached spreadsheet. Note that there is one additional site in Aylesbury Street, Brent, but due to a confidentiality clause in the sale contract the sale price is exempt from disclosure under section 43 of the Freedom of Information Act - the exemption that applies where the release of information would be likely to prejudice TfL’s commercial interests. If TfL were to disclose the sale price it would constitute an actionable breach of contract and would be likely to result in a valid legal claim against TfL, which would impose additional, unnecessary costs against TfL.

The use of this exemption is subject to an assessment of the public interest in relation to the disclosure of the information concerned. TfL recognises the need for openness and transparency in the operation of our business and the fact that you have requested the information is in itself an argument in favour of release. However, in this instance we believe this is outweighed by the need to honour our contractual obligations and to not incur expenditure unnecessarily.
