Thank you for your request received by Transport for London (TfL) on 11th January 2023 asking for information about staff Company Disciplinary Interviews (CDIs).

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. 

Specifically you asked:

How many staff were sent to CDI 2021 to 2022:

Can you please tell me how many staff were sent to CDI in the period stated above? Can you also tell me the percentage of people dismissed after a CDI?”

I can confirm that we hold the information you require. However, our records do not allow us to readily distinguish outcomes by CDIs (“Company Disciplinary Interviews”) as opposed to LDIs (Local Disciplinary Interviews) without reviewing each individual case. With 257 such cases combined in the period in question it is not possible to do this within the costs limit for responding to FOI cases, as set out under section 12 of the Freedom of Information Act. Under section 12, TfL is not obliged to provide information if it would cost more than £450 to determine if information is held, and to then retrieve, locate or extract that information from elsewhere. This is calculated at a rate of £25 per hour, equivalent to 18 hours work. Our HR team estimate it would take 34 hours to review all 257 cases.

In order to bring your request within the costs limit you may wish to reframe it to avoid the need for us to review individual records. Colleagues in HR suggest that it would be possible to answer how many employees were subject to the disciplinary process in all its forms in 2021-22, along with reasons and outcomes (i.e. case dismissed, written warning, final warning, employment terminated) rather than asking specifically about “CDIs”. Please let me know if this would meet your needs and I can process it as a new request.
