Thank you for your email received on 12 March 2017 asking for information about private hire operators and data protection.
Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold the information you require.
As stated in the guide mentioned, ‘Privacy and data protection – A guide for private hire operators’, this document was produced to help private hire operators comply with their responsibilities under the Data Protection Act (1998), and to provide information on best practise when handling personal information.
Like most businesses and organisations that collect personal information, private hire operators are required to adhere to data protection legislation. However, the enforcement of this legislation is beyond Transport for London’s regulatory role and we have consequently not conducted an investigation.
The guidance for operators provides the following information: “The Information Commissioner’s Office (ICO) is the UK’s independent regulator created to uphold information rights and promote good practice. They deal with privacy related complaints and take action to ensure that businesses and organisations of all kinds comply with their data protection responsibilities.”
