Thank you for your email received on 9 March 2017 asking for information regarding the response sent to you in October 2015.
Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy. I can confirm that we do hold the information you require.
We have looked back at our records and the response which was subsequently sent to you in 2015. Our 2015 interpretation of the word ‘area’ as provided in your original FOI, suggested a larger square meterage of highway.
Our 2015 FOI response provided details of a S81 Notice for a TW defect that seemed to meet the criteria of ‘area’, but was located on the footway, and therefore not the exact incident location.
The attached document ‘FOI-2470 Previous’ shows the location for the Notice S810010210 that the original TfL 2015 response refers to, which you will see is footway related, and does not refer to the carriageway defect subject to the claim, nor did it intend to. It was intended to illustrate a Notice in the area, rather than of the exact carriageway location subject to the claim. I am sorry that this was not made clear in our original response.
The attached documents ‘FOI-2470A & B’ show the original carriageway defect, however TfL did not send a S81 notice to the Utility for this.
