In accordance with section 21 of the FOI Act, we are not obliged to supply you with a copy of the requested information as it is already accessible to you elsewhere.
In relation to staff earning under £50k and their job titles, in accordance with the FOI Act we are not obliged to supply this information as it is subject to a statutory exemption to the right of access to information under section 24 (National Security) and section 43(2) (Commercial interests).
Disclosure of the information you have requested would pose a security risk to TfL by exposing people in those roles (which involve direct access to our IT systems and a wide range of data) to unwanted attention, in particular in identifying people/roles to be targeted for attack/bribery and similar in light of the recent cyber incident. Disclosure of information under FOI is regarded as disclosure to ‘the world at large’ and if this information were to be made available in the public domain, it could be used by those with ill intent. Note we make no suggestion that you would use this information for anything other than you own personal interest, however we must consider the possible impact from disclosure of any information we may hold regarding the information you have requested.
The London transport system is a critical piece of national infrastructure and as such we employ rigorous safeguards to protect it from cyber-attack. Like other organisations, we are subject to attempted cyber-attacks. These attacks are unlawful under the Computer Misuse Act, and whilst the motive is not always apparent, we are aware of the risk to critical national infrastructure that may result from a successful attack and providing access to staff members could assist a third party to mount an attack on our IT systems. This information could also be combined with other information available to an attacker or already in the public domain to target our systems.
With specific regard to exemption 43(2) (Commercial Interests), it follows that there would or would likely to be, harm caused to our commercial interests from the release of information which could result in our IT systems being exploited and which would be detrimental to the most effective use of public money and our ability to provide the best possible service to our customers.
The use of these exemptions is subject to an assessment of the public interest in relation to the disclosure of the information concerned. We recognise the need for openness and transparency by public authorities, but in this instance we consider that there is greater public interest in safeguarding our information systems and protecting the integrity of the London transport network as well as ensuring that we are able to obtain the best value for public money. There is a very limited public interest in disclosure of this information, given the wide range of roles covered by the non-specific request that are linked only by virtue of the word ‘data’ but there is a strong public interest in protecting individuals and the organisation from exposing itself to cyber attacks.
