FOI request detail

non journey TPH sexual assaults

Request ID: FOI-2440-1617
Date published: 29 March 2017

You asked

TfL Ref: FOI-2017-1617 As requested, I am narrowing the remit of my FOI request in relation to non "journey related" sexual assault stats by TFL licensed Taxi and Private Hire drivers. Please supply: All information and stats relating to sexual assaults by Taxi and Private Hire drivers outside of the sub-category "journey-related" from 2012 to the present time. TFL took most of 2016 to verify, collate and present these sexual assault figures in the form published under the above sub-category. It would therefore appear logical that if that task was performed competently and professionally, then the other subcategories of sexual assault by TFL licensed drivers currently exist in your data base. On that basis, I do not now expect to be informed that executing my request will take 36 hours or that my request will exceed the 'appropriate limit' of £450 to extract from the TFL database, although one cannot help but wonder what figure would be considered 'appropriate' to expose sexual assault.

We answered

TfL Ref: FOI-2440-1617

Thank you for your request received by Transport for London (TfL) on 7 March 2017 asking for information about non-journey related Taxi and Private Hire driver sexual assault stats since 2012.

Your request has been considered in accordance with the requirements of the Freedom of Information and our information access policy. I can confirm we do hold the information you require.

To provide the information you have requested would exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004.

Under section 12 of the FOI Act, we are not obliged to comply with a request if we estimate that the cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit. This is calculated at £25 per hour for every hour spent on the activities described.

We have estimated that it would considerably exceed the appropriate limit to provide a response to this request. This is because we would need to manually inspect the records of those taxi and private hire drivers where TfL has been informed of a sexual offence. As previously advised, to help bring the cost of responding to your request within the £450 limit, you may wish to consider narrowing its scope so that we can more easily locate, retrieve and extract the information you are seeking. As we have to manually check the records of drivers, we can approximately respond to this request covering 2 years data.

Please note that the data will be from the police disclosures TfL has received from police and will not be cross referenced with the Met’s data in the way that the journey related data was.

If this is not the information you are looking for, or if you are unable to access it for some reason, please do not hesitate to contact me.

Please see the attached information sheet for details of your right to appeal as well as information on copyright and what to do if you would like to re-use any of the information we have disclosed.

Yours sincerely
