Thank you for your request received by Transport for London (TfL) on 29th October 2024 asking for information about the contract TfL has with Cubic Corporation (vendor of revenue/fare collection equipment and services).
Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy.
Specifically you asked:
“Hi, can you please provide the contract (original + any relevant amendments) TfL has with Cubic Corporation (vendor of revenue/fare collection equipment and services)?”.
I can confirm that we hold the information you require.
The original contract and associated schedules can be found in the attached folder. In regard to relevant amendments, please see the Extension Letter that is also attached. Note that a number of redactions have been made to the material under section 43(2) of the Freedom of Information Act, the exemption that applies to information whereby release would prejudice commercial interests, be it TfL on anyone else. In this instance the exemption applies as release of the information would prejudice both TfL and Cubic. The redacted information relates both to the costs involved in the contract and material that is the intellectual property of Cubic. Release of this information would prejudice both parties in negotiating for any similar such contracts in the future.
The use of this exemption is subject to an assessment of the ‘public interest test’, to determine whether the greater public interest rests in the exemption applying and the information being withheld, or in releasing it in any event. In this instance we believe the greater public interest rests in the exemption applying, as the general public interests in transparency and openness are outweighed by the prejudices outlined above. Disclosure would damage the commercial interests of both Cubic and TfL, including in relation to our ability to secure the best value from future procurement processes, which is ultimately to the detriment of the public purse.
