You asked

I am an writing to you in my capacity as official of the PTSC Union (registration number 819T) with reference to a number of our members that once once employed by First Buses Ltd on route 10, that have been recently transferred via a TUPE transfer to London United bus depot. Since and before their transfer they were not consulted as required under TUPE regulation by both companies regarding their transfer. They were simple told that the route was being transferred to London United and that they had to go with it. It has since been confirm following their transfer they were now being told that the route 10 have now been terminated by TFL and that they will have to sign new contracts to be able to be placed on a route of their choosing. Am sure you would agree with me that said terms and condition are protected under TUPE regulation and that London United should not be bulling or forcing TUPE drivers to sign new terms of condition following your closures of route 10. In light of TFL terminating route 10 (no explanation given to our members as to the full reasons why) our members are now being victimize my your operator London United by placing them on worse conditions that they were on before. Am also aware that Unite Officials have raised the same concerns to London United but to no avail. London United to date have not met their obligation under the consultation process despite requesting an audience with them. In light of the termination of route 10 by TFL there now exist a redundancy situation and yet no compensation package have been given to the route 10 drivers by you of London United. The drivers are simply being bullied by a Mr Kelly Rahman (Manager) to except new terms of contract. Am aware in the pass when TFL terminate a job position redundancy payments are offered. Can you please confirm the following to my questions below before deciding to make a subject access request on behalf of my members. a. Have TFL compensated London United for the loss of route 10 (redundancy situation) due to the termination of route 10 services. b. Does TFL make as normal annual bonus payment to drivers via the bus companies. c. When a tender route performs well, does TFL make bonus payments to the drivers via the bus companies. d. Why did TFL allowed a TUPE transfer of route 10 drives when they knew a decisions had already been made to terminate the route and not bring that to the attention of the drivers affected.

Thank you for your request received on 4 December2018 asking for information about the termination of the 10 bus route.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we hold some of the information you require. You asked:

a. Have TFL compensated London United for the loss of route 10 (redundancy situation) due to the termination of route 10 services.

We have not compensated London United. Route 10 was withdrawn as a result of changes to the central London bus network. We understand drivers previously allocated to route 10 would have been offered alternative work within RATP.

b. Does TFL make as normal annual bonus payment to drivers via the bus companies.
c. When a tender route performs well, does TFL make bonus payments to the drivers via the bus companies.

We do not hold this information. Bonus payments to drivers are a matter between staff and the employing bus operator. TfL does not make specific bonus payments to drivers.

d. Why did TFL allow a TUPE transfer of route 10 drivers when they knew a decision had already been made to terminate the route and not bring that to the attention of the drivers affected.

We do not hold information on whether TUPE happened as this contract change from First Group to London United was roughly nine years ago. However as stated above we understand alternative employment has been offered within RATP.
