You asked

On 27 September 2017 Gemma Jacob, General Counsel TfL, told me as part of her Internal Review decision: I can advise that ECPL does hold this information and you are welcome to write to ECPL and request the information. However please note that it will be for the Directors of ECPL to decide on whether to supply it. As a minority shareholder, we can offer a view, but it will be the Directors appointed by Capco who will ultimately decide on whether to supply this information or not. Pursuant to Gemma’s suggestion, I wrote to ECPL and eventually obtained a response. Please see the two emails below. Please supply me with the documents which record the ECPL Board Directors appointed by TfL/TTL being informed about my enquiry, records of any views they offered and issues they considered as to whether or not to provide me with the information I requested, and records of the decision in which they participated, including a record of how those TfL/TTL appointed Directors voted in the decision which resulted in my being denied the information I had requested.

Thank you for your request received on 22 November 2017 asking for information about Earls Court Partnership Limited.

Your request has been considered in accordance with the requirements of the Freedom of Information (FOI) Act and TfL’s information access policy.

I can confirm that we do not hold the information you have requested. Our response to your internal review was discussed in internal meetings which were not minuted, following which we concluded that you should be advised to request the information from ECPL. As you have confirmed in your request, they have refused your request for these documents. We do not hold information on how ECPL have made this decision. We have identified some additional documents as part of your latest request (FOI-1969-1718) and these will be provided to you in due course.

Please accept our apologies that we are unable to assist you further on this occasion.
