Bus Stop U, The High Street, Brentford, TW8 has recently been moved as part of the Cycle Way 9 Provisioning. It has not been moved in line with communicated plans. Please can you provide me with; -A current Road Safety Audit for this bus stop -Communications between TFL, internally and with Hounslow Council regarding the movement of the bus stop, why it was not installed where planned and how the new position was chosen. -Any communication between Bus Operators, Unions to TFL which specifically mention the movement, current position or safety risks with Bus Stop U. -Any communication from third party stakeholders, including those involved in the planning and constructions works regarding Cycle Way 9 between Kew Bridge and the Watermans Park where Bus Stop 'U' is discussed.

Thank you for your request received by Transport for London (TfL) on 29 September 2023 asking for information about Cycleway 9.

Your request has been considered in accordance with the requirements of the Environmental Information Regulations and our information access policy. I can confirm that we hold the information you require.

You asked:
Bus Stop U, The High Street, Brentford, TW8 has recently been moved as part of the Cycle Way 9 Provisioning. It has not been moved in line with communicated plans. Please can you provide me with; 
-A current Road Safety Audit for this bus stop

-Communications between TFL, internally and with Hounslow Council regarding the movement of the bus stop, why it was not installed where planned and how the new position was chosen. 
-Any communication between Bus Operators, Unions to TFL which specifically mention the movement, current position or safety risks with Bus Stop U.
-Any communication from third party stakeholders, including those involved in the planning and constructions works regarding Cycle Way 9 between Kew Bridge and the Watermans Park where Bus Stop 'U' is discussed.

Please note that in accordance with TfL’s obligations under the Data Protection legislation some personal data has been removed, as required by Regulation 13 of the Environmental Information Regulations. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle of the legislation, which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 which would make the processing ‘fair’.

However, given the extent of the information you are looking for, specifically in relation to the last element of your request, Regulation 12(4)(b) applies as we believe that the request is ‘manifestly unreasonable’ because providing all of the information you have requested would impose unreasonable costs on us and require an unreasonable diversion of resources. To explain further, the discussions and correspondence that we hold regarding the bus stop date back to pre-Covid and it is not possible to source all of the information you have asked for and to ensure that we have identified and located all communications between the parties you have specified, noting that there are a number of individuals who have been involved in the issue and there has been changes of personnel over the time period that this issue has been under discussion.

The use of this exception is subject to a public interest test, which requires us to consider whether the public interest in applying the exception outweighs the public interest in disclosure. We recognise that the release of information would promote accountability and transparency in public services and also help address your particular concerns about this issue. However, the time it would take to provide the information you have requested would divert a disproportionate amount of our resources from its core functions and on balance we consider that the public interest currently favours the use of the exception.
