I hope you’re well. I’d like to get a copy of the section 39 (Road Traffic Act 1988) report for the 2008 bus and tram crash in George Street.

Thank you for your email received on 21 February 2017 asking for a copy of the section 39 (Road Traffic Act 1988) report for the 2008 bus and tram crash in George Street. I am sorry for the delay in replying.

 

Your request has been considered under the requirements of the Freedom of Information Act 2000 and our information access policy.

 

I can advise that we do not hold the information you require, as no section 39 report into this incident was required or carried out. In such events the DfT can direct or advise us to carry out a highways programme to investigate the incident, but following the bus-tram incident in 2008, there was no such direction or advice from the DfT. The investigating body was the RAIB (Rail Accident Investigation Branch) because of the involvement of a tram.
