Thank you for your email received on 8 February 2017 asking for the final report about the land slip on the Metropolitan Line.

Your request has been considered under the requirements of the Environmental Information Regulations and our information access policy.

I can confirm that we do hold the information you require, however, in accordance with EIR, we are not obliged to release the report as it is subject to a statutory exemption to the right of access to information under Regulation 12(5)(e) – Confidentiality of commercial or industrial information.

In this instance Regulation 12(5)(e) has been applied as disclosure of the report would, or would be likely to prejudice our commercial interests.

The use of this exception is subject to an assessment of the public interest in relation to the disclosure of the information concerned. Upon this assessment, we have decided that the public interest in maintaining the exception outweighs the public interest in disclosing the information.
