HGV enforcement activity in London.

Two years ago, a study was commissioned by Transport for London carried out by TRL on HGV enforcement activity in London. I would like to put in a Freedom of Information request to see the results of that survey and the conclusion the study came too.

We answered

Thank you for your emails received by us on 2 and 8 February 2017 asking for a copy of our 'Understanding HGV Regulatory Non-Compliance’ report and how much it cost to make.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm that we hold the information you require.

Please find attached the ‘Understanding HGV Regulatory Non-Compliance in London’ report, commissioned by Transport For London (TfL) in November 2014 and completed by Transport Research Laboratory (TRL) in March 2016. The size of the document requires it to be split into several attachments and sent in more than one email.

Please note that in accordance with TfL’s obligations under the Data Protection Act 1998 (DPA) some personal data has been withheld, as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the DPA, specifically the first principle of the DPA which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions of Schedule 2 of the Data Protection Act which would make the processing ‘fair’.

The findings and recommendations from this report are being used to inform our current and future Heavy Goods Vehicle (HGV) and wider freight industry safety and compliance programmes.

The objectives of the research was to:

• Increase TfL’s understanding behind the motivations and reasons for regulatory non-compliance of HGV operators and drivers in London.

• Determine the levels of non-compliance of UK and non-UK based HGVs, drivers and operators within London; (comparable to DVSA National Fleet Compliance Check approach).

• Analyse and draw meaningful conclusions from available roadside enforcement data on HGV operations in London.

• Establish which sectors of the HGV industry; are over-represented in non-compliant HGV operations (determined by a breakdown of business type and operating role); with particular attention to Restricted Operator Licence holders.

• Define specific reasons and motivations to regulatory non-compliance of HGV drivers and operators in London, including intentional and unintentional reasons and any conscious and unconscious client-driven incentives.

• Make recommendations based on sound findings that should be adopted by organisations such as TfL, DfT, DVSA, Police, Traffic Commissioners and the road haulage industry with the objective of increasing the levels of regulatory compliance within HGV operations in London.

The cost of the research was £143,834.

Dear Sir/Madam
Thank you for the reply, I apologise for the delay in getting back to you and the lack of detail in my earlier request.

The name of the study is titled: 'TfL Research Report - Understanding HGV Regulatory Non-Compliance'

We would like the report to be published, we would also like to know how much it cost to make the report.
