You asked

In 2017, the issue of TFL managers talking to LU Occupational Health without consent was raised at the Company Council. Can you provide all documentation specific to this and TFL documented responses to this issue? Can you all provide previous and subsequent instances of this issue being formally raised between 2014 and the present date and all documentation pertaining to this? Can you also let me know if there have been any formal protected qualifying disclosures made in the public interest about this same issue between 2014 and the present date and the outcome of that protected qualifying disclosure?

Thank you for your request received by Transport for London (TfL) on 21 November 2022, asking for information about LU Occupational Health.

Your request has been considered in accordance with the requirements of the Freedom of Information (FOI) Act and our information access policy. 

Unfortunately, to provide the information you have requested would exceed the ‘appropriate limit’ of £450 set by the Freedom of Information (Appropriate Limit and Fees) Regulations 2004. Under section 12 of the FOI Act, we are not obliged to comply with a request if we estimate that the cost of determining whether we hold the information, locating and retrieving it and extracting it from other information would exceed the appropriate limit. This is calculated at £25 per hour for every hour spent on the activities described.

You asked:

Unless you are able to tell us the exact date of the meeting that took place in 2017, we are unable to identify if we hold any documentation and responses specific to this, and locate and extract the information within the appropriate cost limit.

Since 2014 there have been various changes of secretariat for Company Council and several forms of Company Council, i.e. LU, TfL, RfL, TLL that may have covered this. It would be a very burdensome task for someone in the current secretariat to identify and locate all previous secretariat records and then manually search through all areas individually to retrieve and extract records dating back to 2014. Furthermore, some of the documents would be held in our archived records. Locating and collating the relevant information from archived material would of course increase the processing time required to complete your request.

You also asked “if there have been any formal protected qualifying disclosures made in the public interest about this same issue between 2014 and the present date and the outcome of that protected qualifying disclosure”. Unfortunately, from this description, we are unable to identify the information you require. Please provide us with a more detailed description of what you’re seeking so that we can locate the information you require.

To help bring the cost of responding to your request within the £450 limit, you may wish to consider narrowing its scope so that we can more easily locate, retrieve and extract the information you are seeking. If you want to refine your request or make a Freedom of Information Act request in future, please bear in mind that the Freedom of Information Act allows you to request recorded information held by Transport for London. You should identify the information that you want as clearly and concisely as you can, specifying the types of document that you are looking for. You might also consider limiting your request to a more precise period of time, geographical area or specific departments of TfL.
