The Mayor’s response to Question 2018/2612 dated 19 October 2018 http://questions.london.gov.uk/QuestionSearch/searchclient/questions/question_300736 … specifically identifies the "executive responsible for leading TfL's efforts to assist the RAIB, ORR, British Transport Police, SNC-Lavalin and the Coroner” during the Croydon Crash Investigation from the period 9 November 2016 to the present. For the period 9 November 2016 to 20 December 2017, please provide me with copies of (a) any email communication received by the Chair of the TfL Audit Committee discussing the fitness of the “executive responsible for leading TfL’s efforts to assist the RAIB, ORR, British Transport Police, SNC-Lavalin and the Coroner” to hold a leadership position in the Croydon Crash Investigation and (b) any notes, emails, letters, decision memorandums generated in response to such email communication.

Thank you for your request received on 1 November 2018 asking for communications discussing TfL Leadership of the Croydon Crash Investigation.

Your request has been considered in accordance with the requirements of the Freedom of Information Act and our information access policy. I can confirm we do hold the information you require.

In accordance with TfL’s obligations under Data Protection legislation this information has been withheld, as required by section 40(2) of the FOI Act. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle of Article 5 of the General Data Protection Regulation which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed and TfL has not satisfied one of the conditions which would make the processing ‘fair’.

This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption.
