Thank you for your request of 5th January 2021 asking for information about a vehicle with registration xxxxxxxx and whether it was required to pay any congestion charge for the year 2020 and, if so, on which dates / times? On 7th January 2021 you confirmed that you are not the vehicle owner.

Your request has been considered in accordance with the requirements of the Freedom of Information Act our information access policy. 

I can neither confirm nor deny that the information is held. This is because to do so would reveal personal data about the owner of the vehicle (i.e. confirmation of whether or not they were travelling within the congestion charge zone at any point in 2020) in contravention of data protection legislation and section 40 of the Freedom of Information Act, the exemption which which protects against the unfair release of third party data. The ‘neither confirm nor deny’ provisions are set out in section 40(5B) of the Freedom of Information Act, more information on which can be found on the Information Commissioner’s website here:

We do not deem that it is fair to reveal to third parties the movements / whereabouts of other people, and hence the exemption aplies.
