Thank you for your request received by Transport for London (TfL) on 18 September 2024 asking for information about staff medical reviews.
Your request has been considered under the requirements of the Freedom of Information Act 2000 Regulations and our information access policy.
I can confirm that we do hold the information you require. You asked:
Please tell me how many staff in the last 3 years, after having been to rehab, have been asked to attend and take a liver function test and how many have refused or evidence after taking it showed they had relapsed.
All employees are asked to attend for a liver function test post a successful treatment outcome as part of the DAATS process towards evidence of a safe return to the workplace.
Between September 2021 to September 2024, zero out of the 48 employees refused to take a liver function test.
However, in accordance with our obligations under Data Protection legislation we are not able to provide information on relapse. This is because disclosure of this personal data would be a breach of the legislation, specifically the first principle of Article 5 of the UK General Data Protection Regulation which requires all processing of personal data to be fair and lawful. It would not be fair to disclose this personal information when the individuals have no expectation it would be disclosed, and TfL has not satisfied one of the conditions which would make the processing ‘fair’.
This exemption to the right of access to information is an absolute exemption and not subject to an assessment of whether the public interest favours use of the exemption.
